1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of AquaSimple. By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

2. Eligibility and Accounts

• You must be legally able to enter into a binding agreement.
• You are responsible for account credentials and account activity.
• You must provide accurate information and keep it up to date.
• We may suspend accounts used for fraud, abuse, or legal violations.

3. User Content

You retain ownership of content you upload. You grant AquaSimple a worldwide, non-exclusive, royalty-free license to host, process, reproduce, and display your content only as needed to operate and improve the Service.

You are responsible for ensuring your content is lawful and does not infringe third-party rights.

4. Acceptable Use

You agree not to:

• Upload unlawful, harmful, deceptive, or infringing content.
• Attempt unauthorized access to the Service or other user accounts.
• Disrupt infrastructure, automate abusive traffic, or introduce malware.
• Use the Service for spam, harassment, or illegal advertising.
• Scrape or extract data at scale contrary to law or these Terms.

5. Marketing and Monetization Model

AquaSimple may use one or more business models over time, including optional paid features, sponsorships, advertising, affiliate programs, and aggregated market insights.

• Sponsored or promotional content may be shown to relevant audience segments.
• We may offer brand campaigns to users based on activity signals in the Service, consistent with our Privacy Policy and applicable law.
• On store-managed shared aquarium pages, if you are signed in and explicitly opt in to contact sharing, we may share your profile contact details (such as name and email) and your interest in that aquarium with the store so they can follow up.
• Monetization models, feature packaging, and pricing may evolve as the product evolves.

If paid features are introduced or changed, additional commercial terms may apply at checkout.

6. Third-Party Services and Links

The Service may include third-party tools, links, or integrations. We are not responsible for third-party content, products, services, or policies.

7. Intellectual Property

AquaSimple and its original software, design, branding, and non-user content are protected by intellectual property laws and remain our property or our licensors' property.

8. Service Availability and Changes

We may modify, suspend, or discontinue parts of the Service at any time, including features, limits, and interfaces, with or without notice where permitted by law.

9. Termination

We may suspend or terminate access for violations of these Terms, legal risk, security risk, or misuse of the Service.

You may stop using the Service at any time and request account deletion as described in our Privacy Policy.

10. Disclaimers

The Service is provided "as is" and "as available" to the maximum extent permitted by law. We do not guarantee uninterrupted, error-free, or fully secure operation.

11. Limitation of Liability

To the maximum extent permitted by law, AquaSimple will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill.

Our total liability for claims related to the Service is limited to the greater of (a) amounts you paid us in the 12 months before the claim or (b) USD 100.

12. Governing Law and Consumer Rights

These Terms are governed by the laws of Portugal, excluding conflict-of-law rules, unless mandatory local consumer law provides otherwise.

If you are an EU consumer, you keep mandatory rights granted by the laws of your country of residence.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted in the Service with an updated "Last updated" date.
